On August 11, the live casino giant argued that the private intelligence agency’s 118-page affidavit offered nothing new. The company said it contained no substantial information beyond what two regulatory bodies and the New Jersey Courts had already dismissed.
The latest filing includes alleged secretly recorded conversations with current and former Evolution executives. These recordings purportedly show them explaining how their games reached restricted jurisdictions.
The affidavit filing marks the latest twist in a contentious New Jersey legal battle between Evolution and a law firm that fronted a 2021 report. That report accused the company of operating in restricted jurisdictions and wiped $10 billion off its share price.
This year, a state court ruled that the report “lacks veracity” and ordered the disclosure of the entities that commissioned and compiled it. Following that decision, gaming regulators in New Jersey and Pennsylvania closed their probes without taking action.
First reported by NEXT.io, the client’s identity remains a mystery. The law firm, however, revealed that Black Cube was the investigative firm that compiled the report.

The share price of Evolution fell 8% on the Stockholm exchange after Bloomberg reported on the new affidavit.
It has been claimed by the supplier that it has limited control over where its games are ultimately made available because of the widespread use of aggregators.
According to an Evolution spokesperson, the company has no interest in having its games accessible in sanctioned markets. They stressed they are doing everything possible to prevent that from happening. They are in absolute technological forefront with industry-leading solutions to protect the integrity of their games.
In this context, they have repeatedly highlighted these challenges in their financial reports over the past year. The issues include cybercrime, illegal copying of their games, and hijacking of their video streams.
