The STF, or Federal Supreme Court, has taken strict measures. These steps aim to assist in regulating the sports betting market in Brazil. Minister Luiz Fux confirmed betting regulations recently. He highlights the ban on advertising directed at youth categories.
According to a lawyer, professor at USP and one of those responsible for the Betting Law, José Francisco Manssur, grassroots athletes can neither bet nor be the subject of a bet. Base teams cannot have betting sponsorship on their shirt.
Moreover, social programs like Bolsa Família restrict betting for their registered users. Manssur was a special advisor to the Treasury until the beginning of 2024. He explained that with the creation of a register for bettors, it will be possible to cross-check information and prevent individuals in social programs from participating in betting.
Manssur commented that in the last four years, they didn’t have any rules about sports betting advertising. Everyone could say whatever they wanted.
For that reason, this regulation brings more control over advertising. It also helps stop the spread of the misconception that betting is an easy way to get rich.
Minister Flávio Dino of the STF raised another question about sports betting. To prevent result manipulation, he advocates banning bets involving a single athlete.
As a consequence, the measure targets to combat practices like players who manipulate their performances, as in the case of midfielder Lucas Paquetá. The player is facing an investigation in England for allegedly forcing yellow cards to influence betting.
During the trial that upheld Minister Luiz Fux’s injunction, a proposal emerged. It outlined government regulation rules that are set to take effect next year. However, Dino’s point about individual sports betting did not win in the trial.
He believes that there cannot be bets in which the event leading to gains depends on the will of a single individual, highlighting the risk of manipulation. With benefits for a few, he also argues that this type of bet harms consumers and can generate losses for many.
